HB3109 HFA Pushkin 3-27  

Delegate Pushkin moves to amend HB3109 HFA Howell 3-27 on page 1 and 2 by striking out the enacting section, and inserting in lieu thereof, the following:

“To amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §30-2a-1, to read as follows:”

And,

On page 2, line 1, by striking out the remainder of the bill and inserting in lieu thereof, the following:

§30-2A-1. Medical Licensing Board study and report.

(a) For the purpose of study  of consolidation of the following boards into a single regulatory agency, to assure this consolidation will protect human health and properly regulate the affected professions, and to allow the delineated boards provide imput regarding possible consolidation, public hearings must be conducted on each of the following state boards, to determine the feasibility and practicality of consolidation of the boards into one regulatory bureaucracy: Nursing Home Administrators Board, Medical Imaging and Radiation Therapy Board, Board of Examiners for Licensed Practical Nurses, and the Board of Examiners for Registered Professional Nurses.

(b)  Each board shall report back on the results of the public hearing process and recommendations to the Legislative Oversight Commission on Health and Human Resources Accountability, relating the following:

(1)  The general support or opposition of the regulated community to a consolidation;

(2)  Any estimated costs savings to the state from elimination of the board or commission and reduction of licensing fees to the regulated community; and

(3)  The impact on professional accountability, and other impacts that the boards identifies and are represented in the public hearings.”
